Do I Need a CVOR for My Pickup Truck? Understanding the Highway Traffic Act Exemptions

A listener says, Hey Chris, I've got a pickup truck that is 6,500 kilograms and I don't want to get a CVOR. Do I need a CVOR? And the caller went on to say specifically that they are going to remove the box and put a flat deck on there, but it's all for personal use. Well, according to the regulation, and I'll reference the reg at the end of this, there are two exemptions or two pieces of the exemption. And here we go. This is what the Highway Traffic Act says. A pickup truck is exempt from the regulation of six section 16 of the act. If it is being used for personal purposes without compensation and. It is not carrying or towing a trailer that is carrying commercial cargo tools or equipment of a type normally used for commercial purposes. Then it goes on to say in this section, a pickup truck means a commercial motor vehicle that has a manufactured gross weight rating of 6,500 kilograms or less, and is fitted with either. The original box that was installed by the manufacturer, which has not been modified, or a replacement box that duplicates the one that was installed by the manufacturer, which has not been modified. So that's what the regulation says. And because this questioner is going to put a flat deck on their pickup truck, and it is greater than 4,500 kilograms. It's my interpretation, and I'm not no lawyer, but my interpretation of the regs that yes, they will now need A-C-V-O-R because they have removed the original box and put on a flat deck even though they're not doing any commercial work. What a great question. Um, I love these things. I had to look it up to make sure I could reference the correct parts. And if you wanna look it up, it's the Highway Traffic Act, Ontario Regulation 4 2 4 slash 97, and it's called the Commercial Motor Vehicle Operator Information. There you go.
